Jennifer Dolman

Jennifer is a partner in the Toronto office of Osler, Hoskin & Harcourt LLP where she has been practising commercial litigation since 1992 after clerking for the Chief Justice of the Ontario Court (General Division) from 1991 to 1992. The emphasis of Jennifer’s practice is on assisting Canadian and international franchisors with their business critical disputes, including defending claims under Ontario’s Arthur Wishart Act for rescission, breach of the duty of good faith and fair dealing, statutory misrepresentation, and interference with the right to associate, enforcing terminations, and defending franchise group and class actions. She also regularly represents manufacturers and suppliers in their disputes with agents and distributors, and in particular, termination issues. Jennifer also handles intellectual property (including trade-mark and copyright infringement and the protection of trade secrets and confidential information), defamation (including statements made via the Internet), privacy, and employment disputes. She has particular expertise in the area of injunctions and emergency applications, especially regarding the enforcement of restrictive covenants against franchisees, dealers, distributors, licensees or departing senior employees. Jennifer’s practice spans a broad range of industries, including quick service restaurants, retail, pharmacy, automotive, real estate, hospitality, manufacturing and technology. Jennifer has been selected as a Franchise Times Legal Eagle since 2011, named in the Most Frequently Recommended category for Franchising Law (Franchisor) in the Canadian Legal Lexpert Directory since 2011, listed in the Best Lawyers of Canada for Franchise Law since 2008 (named Best Lawyers Toronto Franchise Lawyer of the Year for both 2012 and 2016), included for Franchise in both Who’s Who Legal: Canada (in 2014 and 2015, named one of the 10 most highly regarded lawyers) and the International Who’s Who of Franchise Lawyer (in 2014 and 2015, named one of the 10 most highly regarded lawyers in North America) and has appeared in the Lexpert Guide to the Leading US/Canada Cross-border Corporate Lawyers in Canada since 2013. Jennifer is an active participant in franchise organizations in both Canada and the U.S, is a frequent writer and speaker, the Vice-Chair of the Ontario Bar Association Law Section and sits on the editorial board of the American Bar Association’s Franchise Law Journal.
